Jackson, Marshall, and Indian Removal

The year is 1832.  As part of an influential group, you will be taking a position on whether the United states government is acting within the Constitution in it's relationship with the Cherokee. Each of you is an important voice in the group to which you have assigned. 

 

Once your group has been chosen, you will use research to present a position for or against "checking" the power of the United States government to John Marshall's Supreme Court. Has any branch of the United States government overstepped its powers in dealing with the Cherokee people?  Groups are as follows:

 

1. One of President Jacksons' close advisors sent to defend his position for federal intervention and removal of Indian tribes.

 

2. A Cherokee tribal representative fighting to resist the Unites States Army and remain on the land of your family and ancestors.

 

3. A member of the US Congress, convinced the US Government is in violation of treaty law, and defending the right of the Cherokee to remain sovereign and hold on to their land.

 

4. A member of the US Congress supporting the President in his attempts to use Executive power to remove the Cherokee and other tribes to the Oklahoma territory in the West.

 

5. A settler who wishes to remove the Cherokee in order to access their land and resources, and believes the state and federal government have the right to do so.

 

Once you have researched you position, you will create a Power Point presentation outlining your argument for or against Cherokee sovereignty.  Your ability to clearly and effectively present your arguments is important to swaying the Supreme Court in towards ruling in your favor.  Good luck!
